Transformations in criminal law as a result of social change

Abstract

This paper studies the changes implemented in Germany in the field of criminal penalties and some offenses, as well as the procedural dimension. It warns about the growing phenomenon of “policialización” (“policialization”) in the pre-trial and investigation methods. It also refers to the tendency to strengthen the rights of the victim and the changes in the law of evidence, such as the relaxation of the ban on evidentiary rules in the field of serious crime. Finally it refers to new forms of closing criminal proceedings, especially criminal agreements (plea bargaining), due to the complexity that the investigation of certain crimes has acquired.
